• Interactive Dashboard: Manage features, settings, and analytics.
• Premium Features: Enhanced functionalities available through subscription.

2.2 Usage Restrictions

You agree to use Panais responsibly and not for purposes that:

• Violate the Discord Terms of Service.
• Include the dissemination of illegal, harmful, or copyrighted content without permission.
• Harm the integrity or functionality of the bot, dashboard, or other servers.

We reserve the right to suspend or terminate access for any misuse.

3. Premium Subscriptions

3.1 Payment and Billing

• Premium subscriptions are processed exclusively through Discord's monetization system.
• Payment details are handled directly by Discord; we do not store or process sensitive payment data.
• Pricing, subscription tiers, and billing details are clearly displayed on the premium dashboard.

3.2 Refunds

• Refunds are only issued in compliance with applicable laws or Discord's refund policies.
• Once a subscription period begins, no partial refunds are granted for unused services.

3.3 Termination of Premium Access

• We reserve the right to terminate or suspend your premium subscription without notice for violations of these Terms, Discord’s policies, or non-payment.
• In the event of termination, you forfeit access to premium features, and no refunds will be provided.

4. User Obligations and Acceptable Use

By using Panais, you agree to:
4.1 Not misuse the bot or dashboard for any activity that:

• Promotes hate speech, harassment, or violence.
• Infringes intellectual property rights.
• Exploits the bot for spamming, phishing, or distributing malware.

4.2 Maintain compliance with all rules set by the Discord servers where Panais is used.

4.3 Refrain from attempting to:

• Reverse engineer or hack the bot or dashboard.
• Circumvent technical limitations, subscription requirements, or access controls.

Violations of this section may result in immediate suspension or permanent bans.

5. Data Collection and Privacy

Your privacy is our priority. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data.

5.1 Data We Collect

• Discord Data: Usernames, Discord tags, IDs, and server information.
• Bot Usage Data: Commands issued, interaction logs (limited to optimize functionality).
• Subscription Data: Status and tier of premium subscriptions.

5.2 Data Retention

• Interaction data is retained for up to 30 days for operational purposes.
• Subscription-related data is retained while the subscription is active and for up to 6 months post-expiration.

5.3 Data Protection

We employ industry-standard measures to protect your data, including encryption and secure storage.

6. Disclaimer of Warranties

6.1 Service Availability

Panais is provided "as is" and "as available." While we strive to maintain uninterrupted and error-free services, we do not guarantee:

• Continuous uptime or availability of the bot or dashboard.
• Error-free functionality under all circumstances.

6.2 Limitation of Liability

To the maximum extent permitted by law, Panais is not liable for:

• Indirect, incidental, or consequential damages.
• Data loss, service disruptions, or unauthorized access caused by user negligence or third-party actions.

7. Termination of Services

We reserve the right to terminate or restrict access to Panais at our sole discretion, including but not limited to:

• Violations of these Terms or applicable laws.
• Unauthorized attempts to tamper with the bot, dashboard, or premium services.
• Non-payment of premium subscriptions.

Users whose access has been terminated are not entitled to refunds or compensation.

8. Amendments to the Terms

We may update these Terms at any time to reflect changes in our services, laws, or policies.

• Updates will be announced via the dashboard or on our official Discord server.
• Continued use of Panais after updates implies acceptance of the revised Terms.

9. Intellectual Property

All intellectual property rights related to Panais (codebase, branding, and features) are owned by us. You may not reproduce, distribute, or modify any part of Panais without prior written consent.

10. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes arising from the use of Panais will be resolved exclusively in the competent courts of Besançon.
